Terms & Conditions

1. The Walkers Flavour Cup Fan Club Competitions (the “Competition(s)”) are open to all UK [IoM, Channel Island] and Republic of Ireland residents 16 years and over except employees of Walkers Snacks Limited (the “Promoter”), its affiliated companies, their agents or other companies professionally connected with the Competition(s), and the immediate families of those employees. Please note there are age restrictions for certain Competitions; please refer to the prize specific Special Terms and Conditions for full details.
2. By taking part in the Competition(s) all participants will be deemed to have accepted and be bound by these Terms and Conditions and any applicable Special Terms and Conditions.
3. No purchase necessary.
4. To enter the Competition(s), log onto www.walkers.co.uk (the “Website”), click on your favourite flavour, click on ‘Enter Competition’, correctly answer the skill question and complete the contact details as requested.
5. There will be 2 draws from all correct entries received for each of the 15 Flavour Fan Clubs. The first set of draws will be held on 17/05/10 and the second on 12/07/10.
6. The opening date for the first set of Competition draws is 24/03/10; the second set of Competitions opens 17/05/10. The first 15 draws close on 16/05/10 and the second 15 draws on 11/07/10 (“Closing Date(s)”). Entries must be received no later than 11.59pm on the Closing Date of each Competition.
7. Only one entry per person per competition. No bulk, consumer group or third party entries will be accepted.
8. The winner for each competition for each of the 15 fan clubs will be the first entry, drawn at random, from all correct entries received. The winners will be contacted by email or telephone within 28 working days of each Closing Date. Whereby prize dates are pre-specified and imminent, the winners will be contacted within 7 working days of each Closing Date. In the event that a winner cannot be contacted within this time, the Promoter reserves the right to withdraw prize entitlement and award the prize to another entrant drawn from the original entries received for that Competition.
9. Only one prize per person, household and/or email address.
10. There are a total of 30 Competition prizes to be won; 2 for each flavour fan club with one winner per Competition. Full details of all prizes on offer are available on the Website during the Competition period.
11. There will be one ‘Wrap Up’ Competition for consumers who become a Fan of their favourite Flavour after 11/07/10. The closing date for all entries for the ‘Wrap up’ Competition is 31/10/10.
12. There will be one winner of the ‘Wrap Up’ Competition, to be drawn at random from all correct entries received on 01/11/10
13. Please note prize specific Special Terms and Conditions including age and date restrictions apply to each prize. These Special Terms and Conditions must be read and accepted before entering each Competition.
14. All prizes are subject to availability and may be restricted to specific dates. Should the winner be unable to attend on the required dates, they will forfeit the prize and a new winner will be drawn.
15. Travel or travel allowances are included in some but not all Prizes. Please check the prize specific Special Terms and Conditions for full details.
16. Prizes including international travel require that the winner and any accompanying guests hold a valid and current passport which does not expire prior to the return date to the UK. Travel insurance is included for prizes that consist of travel outside the UK only.
17. Any children participating in a prize must be accompanied by a parent or legal guardian at all times.
18. Any expenses beyond the remit of the prize shall be paid by the winner and will not be funded by the Promoter. This includes but is not limited to travel, transfers, food, beverages, clothing, equipment, passports, visas and taxes not already included as part of the prize.
19. Prizes are non-transferable, non refundable and cannot be exchanged for any cash alternatives in whole or in part. The decisions of the Promoter are final and no correspondence will be entered into.
20. Confirmation of the prize and how it is redeemed by the winner will be delivered to the winner’s designated address within 14 days of the winner’s acknowledgement of the prize.
21. The Promoter reserves the right to provide an alternative prize of equal or greater value in the event of unforeseen circumstances.
22. Winners accept that by entering any of the Competitions they may be required to take part in related publicity. Winners may have their name and county displayed on the Website.

24. Any Personal data relating to participants will be used solely in accordance with current data protection legislation and will not be disclosed to a third party without the individual’s prior consent. The sole exception to this would be where the data may be provided to a third party company, such as a handling house, for the sole purpose of delivering a service to the winner on our behalf, for example for the purpose of delivering a prize.
25. All entries become property of the Promoter on submission.

Limitation of Liability

1. All winners take part in the prizes at their own risk and the Promoter accepts no liability with regard to such prizes whatsoever.
2. The Promoter will have no liability in relation to the conduct of the winner or their guest, nor in connection with any circumstances outside its control with respect to the prize once delivered to the winner
3. All winners are subject to the policies and Terms and Conditions of any and all third parties involved in the fulfilment of each prize. Any Terms and Conditions applicable to prizes have been provided to the fullest extent possible in the prize specific Special Terms and Conditions.
4. The Promoter will not be liable for any delayed or non-delivery of emails to participants. It is the responsibility of the registered user to check that emails from the Promoter will not be automatically classed as "junk" or "spam" and sent to the user's junk mail filter or otherwise filtered or deleted.
5. The Promoter cannot accept responsibility for any technical or other problems that mean participation is impossible or delayed, or entries are not accepted for any reason whatsoever.
6. The Promoter does not guarantee continuous, uninterrupted or secure access to the Website. Numerous factors outside of the control of the Promoter may interfere with the operation of the Website. To the extent permissible by law the Promoter excludes all implied warranties, conditions and other implied terms.
7. If, for any reason, this Competition is not capable of running as planned the Promoter reserves the right to cancel, terminate, modify or suspend all or part of it. This includes but is not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter.
8. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of or unauthorized access to, or alteration of, or non-receipt of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter or an entrant because of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to any participant's or any other person's computer related to or resulting from participation or downloading any materials in this Promotion.

Infringement of Terms and Conditions

1. The Promoter reserves the right in its sole discretion to disqualify any person who corrupts or affects the administration security, fairness, integrity, or proper conduct of this Competition, who tampers with the entry process, or may benefit from such tampering.
2. Any attempt to deliberately damage the Website or the information on it, or to otherwise undermine the legitimate operation of the Competition(s) may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
3. Participants must not use the Website on behalf of another individual without that individual's express permission.
4. The Promoter reserves the right to terminate the entry of any person who it reasonably suspects has violated or infringed any of these general Terms and Conditions.
5. The Competition(s) and these Terms and Conditions shall be governed by the laws of England and Wales. By participating in the Competition(s) you agree to submit to the exclusive jurisdiction of the courts of England.
